Paul Ramsey has argued that the rule of double effect is morally significant because of the existence of indeterminate choices between incommensurable values. I interpret his argument as the following disjunctive syllogism. There are two sorts of principles we can appeal to in dealing with indeterminate choices: the rule of double effect and a commensurate reason principle. The second does not work, so we are left with the first. I respond, first, that this argument commits the fallacy of bifurcation and (...) second, that for all Ramsey has shown, and surprisingly, a commensurate reason principle can deal with indeterminate choices. Brad Hooker argues for rule consequentialism using narrow reflective equilibrium resources along with a handful of wider resources. One of his important claims in defense of rule consequentialism is that it begins from a familiar and attractive idea about morality. I argue that his defense of rule consequentialism fails and more particularly, that rather than beginning from a familiar and attractive idea, it begins from an idea that is quite unattractive. I show this by applying the method rule consequentialists use (...) to derive moral advice for the real world to non-moral cases where its unattractiveness is clear. I then argue that the basic idea behind rule consequentialism is attractive if considered as an account of moral reform, in so far as the account of moral reform can be divorced from one’s account of right and wrong, something that occurs in theories like that of Stephen Toulmin. Philippa Foot's book, Natural Goodness, involves a large project including a theory of natural goodness, a theory of the virtues, and a theory of practical rationality. Natural goodness is the foundation for the rest and is used to support a more or less traditional list of the virtues and a theory of reasons for action. Though Foot's doctrine of natural goodness may provide an account of some sort of goodness, I argue that it is not adequate as a foundation for (...) practical rationality or as a defense of more or less traditional virtues. Much anthropocentric environmental argument is limited by a narrow conception of how humans can benefit from nature. E. O. Wilson defends a more robust anthropocentric environmentalism based on a broader understanding of these benefits. At the center of his argument is the biophilia hypothesis according to which humans have an evolutionarily crafted, aesthetic and spiritual affinity for nature. However,the “biophilia hypothesis” covers a variety of claims, some modest and some more extreme. Insofar as we have significant evidence for biophilia, it (...) favors modest versions which do not support a particularly robust anthropocentric environmental ethic. A significantly more robust environmental ethic requires the most extreme version of the biophilia hypothesis, for which there is the least evidence. (shrink)

In this essay, I distinguish two significant act-utilitarian theories of moral education: the traditional rule of thumb view and the Harian intuition view. I argue that there are problems with the traditional view and that an act-utilitarian ought to adopt a version of the Harian view. I then explain and respond to a major objection to the intuition view given by Bernard Williams. Williams argues that the system of moral thought which the Harian view advocates we teach is inherently unstable (...) and is certain to undermine itself. I argue that there is reason to expect a great deal of stability in this system. (shrink)

Versions of internalism have played important roles in metaethics, for example, in defending irrealist options such as emotivism. However, internalism is itself as controversial as the views it is used to defend. Standard approaches to testing the view, such as thought experiments about amoralists, have failed to gain consensus. Michael Huemer offers a defense of internalism of a different kind which he calls the “argument from interpretation.” He presents the argument as one Humeans could embrace, but versions could be accepted (...) by others, including Huemer himself. The argument begins from the assumption that a certain principle of charity is true and knowable a priori. But it can only be known a priori if internalism is true. Hence internalism is true. In this paper I argue that this important argument fails. My main objection makes use of recent work in empirical psychology. Huemer needs the principle of charity to be known a priori. I argue that rather than being an a priori issue, it is an empirical one and that the empirical evidence is strong enough to undermine his argument for internalism. (shrink)

In this paper, I provide a defense of rule consequentialism that does not appeal to the “guiding teleological idea” according to which the final ground of moral assessment must lie in effects on well-being. My defense also avoids appeals to intuition. It is a contractualist defense. Many forms of contractualism can, with only minor tweaking, be used to defend rule consequentialism. In this paper I show how one specific form of contractualism does the job. This argument is inspired by a (...) version of contractualism briefly discussed by Tim Mulgan and by his claim that it converges with rule consequentialism, given certain restrictions. I show that Mulgan’s own argument for convergence is seriously flawed, but that a variation on his contractualism does converge with rule consequentialism, and it does it without Mulgan’s own restrictions. Though Mulgan himself does not treat convergence as an argument for rule consequentialism—his own argument is heavily intuitionistic—I claim that convergence provides significant support for rule consequentialism. One problem for any utilitarian alternative to act utilitarianism, such as rule utilitarianism, is the feeling that act utilitarianism is the most natural form of utilitarianism. Other forms seem unmotivated, inconsistent, or irrational. This argument is found in Smart, Foot and Slote. It turns on the assumption that utilitarianism must be motivated by the "teleological motivation," the idea that one must derive one's entire moral theory from the notion of the good. I respond that act utilitarianism itself has a problem (...) from the point of view of the teleological motivation, a problem solved, surprisingly, by several utilitarian alternatives including rule utilitarianism. There has long been interest in deriving evaluative conclusions from nonevaluative premises. I revisit two classic attempts at this derivation by Philippa Foot and John Searle. They try the derivation using “thick arguments.” I argue that all thick arguments fail. Their failure is not due to a special feature of morality or of moral language, as many critics have charged. Rather it is because the thick evaluative terms are theoretical terms.

In response to criticisms of his "Ambiguity in Moral Choice", Richard McCormick developed, in "Commentary on the Commentaries," an alternative view on proportionate reason. I interpret McCormick's view in terms of what I call "the undermining principle," "the theory of associated goods," "the necessity principle," and "the liberty principle." I argue that the first two are the heart of the theory and link McCormick's view to that of Peter Knauer. I then show that McCormick's view suffers from several problems, including (...) a lack of argumentation for his central undermining principle, and counterexamples to his necessity and liberty principles. Torture has become the subject of intense debate in recent years. One facet of that debate is whether there are any circumstances during which it might be an appropriate response by a respectable government. One might wonder precisely why torture receives so much more attention than, say, the "collateral damage" that is an inevitable aspect of contemporary warfare. But the debate also involves what counts as "torture," as distinguished from "cruel, inhuman, and degrading" methods of interrogation or even "coercive but (...) acceptable" methods. This article argues that we sometimes overemphasize the significance of particular acts — i.e., x either is or is not torture — as against the importance of the phenomenology of torture, which involves creating a structure of complete domination and, therefore, complete vulnerability. This is similar to the phoenomenology of slavery. Indeed, in this 150th year since the Supreme Court's decision in the Dred Scott case, it is important to contemplate the full meaning of Chief Justice Taney's declaration that blacks had "no rights" that whites were "bound to respect." Can a liberal political order ever carve out a set of persons — such as suspected terrorists — who indeed have "no rights" that the state is obligated to respect? If the answer is no, then what are the implications for the process by which the United States, presumably a liberal political order, conducts interrogations even of those suspected of being "the worst of the worst"? James C. Scott’s book The Art of Not Being Governed is offered, in this essay review, as the latest evidence of the high value of Scott’s transdisciplinary research into how ordinary people resist state power. Scott’s critics have found his work methodologically deficient, suggesting that his approach is more a matter of art than of science. In this defense of methodological pluralism, Scott’s approach is shown to be vindicated by his insights into how the peoples of (...) Zomia evolved ways to evade incorporation, over a period of centuries, into any of the states of Southeast Asia. Scott’s book is examined as a prime example of how the study of politics can and should help to effect political change — and its insights on anarchism as a way of life are applied to the Occupy Wall Street movement. One might think that if the majority of virtue signallers judge that a proposition is true, then there is significant evidence for the truth of that proposition. Given the Condorcet Jury Theorem, individual virtue signallers need not be very reliable for the majority judgment to be very likely to be correct. Thus, even people who are skeptical of the judgments of individual virtue signallers should think that if a majority of them judge that a proposition is true, then that provides (...) significant evidence that the proposition is true. We argue that this is mistaken. Various empirical studies converge on the following point: humans are very conformist in the contexts in which virtue signalling occurs. And stereotypical virtue signallers are even more conformist in such contexts. So we should be skeptical of the claim that virtue signallers are sufficiently independent for the Condorcet Jury Theorem to apply. We do not seek to decisively rule out the relevant application of the Condorcet Jury Theorem. But we do show that careful consideration of the available evidence should make us very skeptical of that application. Consequently, a defense of virtue signalling would need to engage with these findings and show that despite our strong tendencies for conformism, our judgements are sufficiently independent for the Condorcet Jury Theorem to apply. This suggests new directions for the debate about the epistemology of virtue signalling. (shrink)

There is a wealth of evidence which indicates that arguments are not very efficient tools for changing minds. Against this scepticism, Dutilh Novaes (2023) presents evidence that, given the right social context, arguments sometimes play a significant role in belief revision. However, drawing on Levy (2021), I argue that the evidence Dutilh Novaes cites is compatible with the view that it is not arguments that change individual minds but instead belief outsourcing that occurs alongside the consideration of arguments.

Recourse to meta-argument is an important feature of successful argument exchanges; it is where norms are made explicit or clarified, corrections are offered, and inferences are evaluated, among much else. Sadly, it is often an avenue for abuse, as the very virtues of meta-argument are turned against it. The question as to how to manage such abuses is a vexing one. Erik Krabbe proposed that one be levied a fine in cases of inappropriate meta-argumentative bids (2003). In a recent publication (...) (2022) Beth Innocenti expands on this notion of a penalty, arguing that some meta-arguments should be halted with “shouting, cussing, sarcasm, name-calling.” In this essay, we review Innocenti’s case that these confrontations and haltings improve the argumentative circumstances. We provide three reasons that this promise is not well-founded. First, that such confrontations have a significant audience problem, in that they are more likely to be interpreted as destroying the argumentative context than improving it. Second, that Innocenti’s procedural justification, that those who lose meta-discussions should pay a penalty, is not satisfied if the meta-discussion is halted. And third, there is a boundary problem for the cases, since it seems there is no principled reason to restrict halting meta-arguments just to these cases (especially if there is no meta-discussion on the matter to make the bounds explicit). Though expressions of anger can be appropriate in argument, we argue, it cannot take the place of argument. (shrink)

Abortion jurisprudence in the United States has been criticized by many for allowing the destruction of millions of lives. What many may not know is that the Supreme Court decision which legalized abortion in all fifty states was very similar to another Supreme Court decision, namely, Dred Scott v. Sanford. The parallels between these two cases are astounding, revealing how dehumanization, while a very old idea, is almost always achieved through the same means. A legal analysis of Roe (...) v. Wade, and subsequently Planned Parenthood v. Casey, shows that these cases are both morally and legally unjustified. Just like Dred Scott, Roe, by dehumanizing a specific group of individuals, is a case which does not belong in the American legal system. (shrink)

Scott Woodcock has levied a number of objections against Aristotelian naturalism which claims that ethical norms are grounded by reason and biology. His most recent “membership objection” is a synthesis of earlier objections and consists in a trilemma. If Aristotelian naturalists answer the first horn of the trilemma by stipulating that determinations of species-membership are grounded non-empirically, and the second horn of the trilemma by stipulating rationality is species-specific, then they are confronted by a moral outsider—someone who claims that (...) they have non-empirically determined their species membership and are thus guided by different norms of rationality than the rest of us. This permits the moral outsider to act heinously without moral sanction from Aristotelian naturalism. Critics have neglected Alasdair MacIntyre’s Aristotelian naturalism. And he has faced moral-outsider-type counterexamples before. I develop a new response to counterexamples MacIntyre’s account has faced and argue that MacIntyre’s Aristotelian naturalism is able to answer Woodcock’s membership objection. I do this by developing an empirical taxonomy-based approach that enables us to justify the moral outsider’s responsibilities while preserving the best of Aristotelian naturalism. (shrink)

This article examines the issue of intergenerational cohabitation in the family home. Its primary purpose is to demonstrate that current analysis of internal conflicts in the home is lacking, both in terms of identifying the parties’ interests and characterizing the tensions involved. It focuses on a specific three-way conflict between two parents and their adult child and identifies each of their points of view: one parent who wants the adult child to move out, one parent who wants to continue to (...) share her home with the adult child, and the adult child who wants to remain in the home.The article builds on rich multidisciplinary literature on the meaning of the home. This focus sheds new light on the conflict in two significant manners. First, the disagreement between the parents is characterized as a struggle between two conflicting visions of the home. Each of these visions reflects a different perception of the home, the family, and intergenerational commitments. Second, the focus on the home allows lawyers to acknowledge the position of the adult child, whose interest is completely not sufficiently taken into account in the conventional analysis. (shrink)

Often scholars who call themselves social scientists have not meant by the term science the sort of activity which has generally concerned those calling themselves natural scientists. In the latter sense very little of what has been called “social science” can also be called scientific. The term “social science” as used here refers primarily to the studies which have gone under such titles as Politics, Sociology, Anthropology, Social and Clinical Psychology, and Economics. To some degree much of what will here (...) be said does not apply with equal justice to the field of Economics. It has a more highly developed system of general abstractions and considerably more precise techniques of analysis than have generally characterized the other social sciences. The difference, however, is one of degree not kind. Many of the difficulties mentioned below certainly plague the field of Economics as well as the others. (shrink)

Accounts of mechanistic explanation, especially as applied to biology and sometimes going under the heading of “new mechanism,” provided an attractive alternative to nomological accounts that preceded them. These accounts were motivated by selected examples, drawn primarily from cell and molecular biology and neuroscience. However, the range of examples that scientists take to be mechanistic explanations is far broader. We focus on examples that differ from those traditionally recruited by Mechanists. Our contention is that attention to additional examples will lead (...) to a richer conception of mechanistic explanation, prompting a shift from what we refer to as Mechanism 1.0 to Mechanism 2.0. This article examines the implications of mandatory conscription for women by studying the experience of women soldiers who serve as secretaries in the Israeli military. The author argues that the military service of the secretaries is shaped by three organizing principles: an employment principle of cheap labor, a matrimonial principle of the office wife, and a hierarchy principle that shapes the secretaries as status symbols. Employing the theory of gendered organizations, the author maintains that each one of these organizing principles (...) operates as a gendering and a power mechanism. The convergence of these three gender/power principles results in overgendering of these women and their military experience. This overgendering reflects gender discrimination and creates feelings of alienation and frustration. For them, military service is not an experience that articulates their citizenship or enhances feelings of national belonging but rather stands in opposition to the values and goals of the mandatory people's army by estranging them from the state and its major institution.
